No, s/he can be an international citizen, have settled in the UK or under the humanitarian protection in the UK.
If you are already in the UK and from outside the EEA and Switzerland region, you can apply for a Partner Visa.
The validation of the visa is 2 years and 6 months. After that period you can apply to extend your visa while you still have your Partner Visa. Additionally, you can apply for a settlement in the UK, provided that you meet the eligibility criteria.
Successful applicants can work in any sector and study at any college or governmental institution. They can also bring their family members to the UK. After a 5-year period, Indefinite Leave to Remain becomes an option for this type of visa.
If your partner is EEA (excluding the UK) or Switzerland citizen, you can apply for an EEA family permit to live in the UK. In order to be granted this permission, you also have to be an EEA citizen.
You have to apply for a Dependent Partner Visa with his/her original visa.
Firstly, you need to choose your route (category) which all have differing requirements for each. There are 2 types of routes; 5-year and a 10-year routes. The selection of route has an impact upon the duration of the application to settle permanently in the UK. You cannot apply for this visa whilst holding a visitor visa.

You do not need to demonstrate your language level in the 10-years route. However, you may need to satisfy certain English requirements for other routes unless you are excluded.
